Commercial API Terms

1. What the API provides

The API serves structured visa-requirement facts for passport/destination country pairs - requirement type, permitted stay, official links, and the date each row was last verified - assembled from a community-maintained open dataset (see Section 7). It is general informational data, not advice, and not an official government feed.

2. License to use the API and data

Subject to these terms and your tier’s limits, DoINeedVisa grants you a non-exclusive, non-transferable, revocable license to call the API and to use and display the returned data within your product or service. Redistribution and resale are permitted only where the upstream MIT license allows it and only if you carry the attribution notice in Section 7 with any substantial portion of the data. You may not remove or obscure that attribution.

3. Not for compliance, boarding, or eligibility determinations

The data must not be used as the basis for compliance, boarding, admission, or visa-eligibility determinations, or for any decision that affects a person’s ability to travel, board a carrier, enter a country, or obtain a visa or permit. Visa requirements change frequently, vary by individual circumstance, and are set solely by destination governments. Any such determination must be made against official government sources. You are responsible for your own use of the data and for any decision you or your systems make from it.

4. No warranty

The API and its data are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, timeliness, non-infringement, merchantability, or fitness for a particular purpose. DoINeedVisa does not warrant that the data is correct or current, that the API will be uninterrupted or error-free, or that any defect will be corrected.

5. Limitation of liability

To the maximum extent permitted by law, DoINeedVisa and its operator are not liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the API or reliance on its data - including denied entry, denied boarding, missed or cancelled travel, deportation, fines, or visa-application costs incurred by you or by any end user of your product. This applies regardless of the theory of liability and even if DoINeedVisa was advised of the possibility of such damages. Where liability cannot be excluded, it is limited in the aggregate to the greater of the amount you paid DoINeedVisa for API access in the three months preceding the claim, or US$50. You agree to indemnify DoINeedVisa against third-party claims arising from your use of the data in breach of these terms, including any Section 3 use.

6. Acceptable use

• Keep your API key secret. It is your sole credential; you are responsible for all calls made with it. Report a suspected leak so it can be rotated.
• Stay within your tier’s rate limits and quota. Don’t share keys across unrelated products, circumvent metering, or run multiple free keys to evade limits.
• Don’t use the API to build or train a competing bulk visa-data product, or to scrape the full matrix for wholesale redistribution outside the Section 2 license.
• Don’t use the API for unlawful purposes or in a way that degrades the service for others.

7. Data source & attribution (MIT)

Visa-requirement data is sourced from passport-index-data (scraped from passportindex.org), which is MIT-licensed. MIT permits commercial use and redistribution but requires that the copyright and permission notice travel with all copies or substantial portions of the data. The API serves a substantial portion, and every data response carries a short-form attribution in the source field and the X-Data-Source header. If you redistribute or expose this data, you must reproduce the notice below.

8. Tiers, fees & payment

Free-tier access is provided at no charge within its published quota. Paid tiers (agency, enterprise), when purchased, are billed per the plan you select; quotas and limits are enforced per key. Fees are non-refundable except where required by law. DoINeedVisa may change tier pricing or limits on reasonable notice; a change does not affect a billing period already paid for.

9. Suspension & termination

DoINeedVisa may suspend or revoke a key, or terminate access, for breach of these terms (including any Section 3 or 6 breach), for non-payment, or where required to protect the service or other users. You may stop using the API at any time. Sections 3–7 and 10 survive termination.

10. Changes to these terms

These terms may be updated from time to time; the “last updated” date above will change accordingly. Material changes affecting paid tiers will be communicated to the account contact. Continued use of the API after an update means you accept the revised terms.

11. Governing law

Draft placeholder - fill in your jurisdiction of residence/operation before paid tiers open, consistent with §9 of the consumer Terms. Common indie-project choice: your home state/country’s law, with disputes handled there.
